Privacy Policy

Privacy Policy of the mobile application Moodpresso and the website located at www.moodpresso.com.

1. This Privacy Policy ("Privacy Policy") covers the Operator’s treatment (i.e. collection, usage, securing, and sharing) of personal and non‑personal data that the Operator collects when you: (a) access or use the Site, and (b) use the App and provided Service. Capitalized terms not defined herein shall have the meaning set forth in the Terms and Conditions available at www.moodpresso.com/terms.
2. The personal data administrator will be the Operator who processes your personal data in compliance with the provisions of the Polish Personal Data Protection Act of 29 August 1997 (Journal of Laws no. 133 item 883, as amended).
3. By using the Site or the App, you freely and specifically give the Operator your consent to collect and store your personal data in the United States of America and Poland and to use the data as specified within this Privacy Policy.
4. In addition to the information you provide to the Operator, when you use the Site, you automatically submit information about the computer, mobile device, or other devices you use to access Site and about how you use the Site. In order to improve the services and marketing efficiency, the Operator collects the following information: your browser version, IP address, language, operating system, the date and time of your visit, your activities on the Site, the web page that led you to the Site, and the exact address used to enter the Site. The Site does not use cookies.
5. Through the App the Operator automatically collects the following data:
   1. User’s first name, i.e. the name provided by the User in the App;
   2. User’s chosen language;
   3. information about User’s mobile device: device model, operating system, WebView version;
   4. usage data: statistics about the App’s launches, statistics about Programs’ runs, statistics about specific activities in Programs, User’s evaluations of his or her current state of mind;
   5. if and which social sharing was used.
   The data is collected for the purpose of delivering the Service, improving the Service, improving marketing efficiency, and using aggregated, anonymized data in marketing messaging.
6. As a part of providing feedback about the App the User may asked for the following demographic information: gender, age range, and occupation. Providing this information is optional. This data is collected for the purpose of improving the Service and marketing efficiency.
7. Occasionally the Operator can use push notifications in the App to send the User messages about the App, available Upgrades and related offers. The User may opt out from receiving push notifications through the device settings.
8. The Operator does not access or track any location‑based information from User’s mobile device.
9. The Operator reserves the right to disclose User’s non‑personal data, i.e. only the data that cannot be used to identify the User, to third parties, for scientific research purposes.
10. By providing Suggestions the User agrees to the Operator using them together with User’s first name in marketing materials of any kind.
11. The Operator may engage third party service providers to work with the Operator to administer and provide the services related to the Site or the App. These third party service providers have access to your personal data only for the purpose of and in the scope necessary to performing services on the Operator’s behalf and are expressly obligated not to disclose or use your personal data for any other purpose.
12. In the event that the Operator’s business transforms into another company or another company acquires all or substantially all of the assets of the Operator’s business through a consolidation, merger, asset purchase, or other transaction, the Operator reserves the right to transfer all information (including any personal data you may have provided) that is in the Operator’s possession to such company.
13. The Operator reserves the right to disclose selected data concerning the User to competent authorities or third parties upon request for such information, based on an appropriate legal basis and in accordance with the applicable laws.
14. The Operator takes reasonable technical and organizational measures to protect the data collected from or about you from unauthorized access, use or disclosure and processing in violation of the law, modification, damage or loss. Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, the Operator cannot guarantee the absolute security of any data.
15. The Service is not directed to children under 13 and the Operator does not knowingly collect personal data from children under 13. If the Operator learns that personal data of a child under 13 have been collected, the Operator will take steps to delete such information from the storage as soon as possible.
16. Any data that the Operator collects is subject to the Privacy Policy in effect at the time such data is collected. The Operator reserves the right to make changes to the Privacy Policy for important reasons at any time. Changes may be dictated by changes in applicable law, changes in technological, legal, economic, or organizational aspects of the Operator’s business, as well as changes in the offered Service. Amendments to the Privacy Policy take effect upon posting the amended Privacy Policy on the web page www.moodpresso.com/privacy. The changes are considered accepted by the User from the moment of his or her subsequent use of the App.
17. You can request to access, modify or delete your personal data you provided or the Operator otherwise collected via the Site or the App by contacting the Operator at contact@moodpresso.com.

19. The Privacy Policy is subject to Polish law. In case of differences in interpretation, the Polish version of the Privacy Policy is binding in all respects.
